Understanding the H-1B Visa

The H-1B visa is designed to allow U.S. employers to temporarily employ foreign workers in specialty occupations that require specialized knowledge and a higher educational degree. This visa category not only benefits employers by filling critical skill gaps but also provides qualified professionals the chance to contribute their expertise to the American workforce.

H-1B Visa Requirements

1. Specialty Occupation

The job you are being hired for must qualify as a "specialty occupation." This generally requires a minimum of a bachelor's degree or equivalent in a specific field related to the position.

2. Employer-Employee Relationship

Your U.S. employer must demonstrate a bona fide employer-employee relationship with you. They should have the ability to hire, pay, fire, and supervise your work.

3. Labor Condition Application (LCA)

Your employer must file an LCA with the U.S. Department of Labor, affirming compliance with prevailing wage requirements and working conditions for H-1B workers.

4. Educational Qualifications

You must have the necessary educational qualifications for the specialty occupation. This typically involves at least a bachelor's degree or equivalent.

5. Specialty Occupation Job Offer

You must have a valid job offer from a U.S. employer for a specialty occupation role that matches your qualifications.

6. Cap Limitations

There is an annual cap on the number of new H-1B visas that can be issued. Some employers, such as institutions of higher education and certain nonprofit organizations, are exempt from this cap.
